ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNITY AGREEMENT
Please read carefully before signing. By signing, you give up certain legal rights.
1. Activities. I want to take part in group fitness classes, personal training, open gym and related activities at Nerd Strong (the "Studio"), including strength training, conditioning, weightlifting, gymnastics, running, rowing, jumping and the use of equipment.
2. Risks. I understand that these activities carry risks, including but not limited to muscle strains and sprains, broken bones, joint and back injuries, heart attack, stroke, heat illness, dizziness and fainting, injuries from equipment or other people, and in rare cases permanent disability or death. I understand that some risks can't be removed even when everyone takes care.
3. My health. I confirm that I am physically able to take part. I will tell a coach about any injury, illness, pregnancy or medical condition that could affect my training before class. I have been advised to see a doctor before starting an exercise program. I will stop and tell a coach if I feel pain, dizziness or discomfort.
4. Following instructions. I will follow coaches' instructions and the Studio's rules, use equipment only as shown, and train within my limits. I may scale or skip any movement.
5. Assumption of risk. I take part voluntarily and accept all risks, known and unknown, whether caused by my own actions, the actions of others, the condition of the premises or the equipment.
6. Release. To the fullest extent the law allows, I release the Studio, its owners, employees, coaches and contractors from all claims for injury, illness, death or loss of property arising from my participation, including claims caused by their ordinary negligence. This release doesn't cover gross negligence or intentional misconduct.
7. Indemnity. I agree to cover the Studio's costs, including reasonable legal fees, for any claim made against it because of my participation or my breach of this agreement.
8. Medical treatment. If I'm injured or become ill and can't decide for myself, I allow the Studio to call emergency services and arrange first aid or medical treatment for me. I'm responsible for the cost of that treatment.
9. Personal property. The Studio isn't responsible for lost, stolen or damaged belongings.
10. Minors. If I'm signing for a person under 18, I'm their parent or legal guardian, I agree to these terms on their behalf and on my own, and I accept responsibility for their participation.
11. The whole agreement. This agreement is governed by the laws of the state where the Studio is located. If any part is found unenforceable, the rest still applies. It stays in effect for as long as I train at the Studio.
I have read this agreement, I understand it, and I sign it voluntarily.
